1. Introduction

1.1 This Intellectual Property Policy sets out the ownership and permitted use of intellectual property in connection with the website ozprint.com.au (the "Website") and the services provided by OzDynamics, trading as OzPrint ("Ozprint", the "Company", "we", "us" or "our").

1.2 This Policy should be read together with the Company's Website Terms and Conditions and Manufacturing Services Terms and Conditions.

2. OzDynamics Intellectual Property

2.1 Unless otherwise indicated, the Company owns, or is licensed to use, all intellectual property rights in:

(a) Website content;

(b) branding and trading names, including "OzPrint";

(c) logos;

(d) photographs;

(e) graphics;

(f) written material; and

(g) proprietary processes, methods, workflows and technical know-how.

2.2 These rights are protected by Australian law, including the Copyright Act 1968 (Cth) and the Trade Marks Act 1995 (Cth), and by applicable international law.

3. Permitted Use of Website Content

3.1 Users may access and view the Website, and may print or download extracts of Website content, for legitimate informational and service enquiry purposes only.

4. Restrictions

4.1 Except as permitted under clause 3 or as otherwise permitted by law, users must not reproduce, modify, adapt, publish, distribute, communicate, commercially exploit or create derivative works from any OzDynamics intellectual property without the Company's prior written permission.

4.2 The "OzDynamics" name and associated logos must not be used, including in connection with any product or service, without the Company's prior written consent.

5. Customer Intellectual Property

5.1 Customers retain ownership of all intellectual property in the materials they submit to the Company, including:

(a) submitted CAD files;

(b) drawings;

(c) confidential designs; and

(d) proprietary information.

5.2 Customer materials are used by the Company only under the limited, non-exclusive licence described in the Manufacturing Services Terms and Conditions, for purposes including quotation, manufacturing, quality control, archiving and customer-requested repeat orders.

6. Company-Created Designs

6.1 Ownership and licensing of CAD designs created by the Company are governed by the Manufacturing Services Terms and Conditions. In summary, copyright in Company-created designs remains with the Company, and the customer receives a perpetual, royalty-free licence to use the relevant design for its intended purpose following full payment.

7. Infringement

7.1 If you believe that material on the Website infringes your intellectual property rights, or if you become aware of unauthorised use of OzDynamics intellectual property, please contact us at legal@ozprint.com.au.

7.2 The Company reserves all rights and remedies available at law in respect of any infringement of its intellectual property.
